Embuild Vlaanderen and Buildwise respect your rights when processing your personal data and project data. When we process your personal data, we do so in accordance with the principles of the European General Data Protection Regulation (GDPR), which has been in force since May 25, 2018.

Contact form

Embuild Vlaanderen and Buildwise reserve the right, based on their legitimate interest in networking, to use data from visitors to the website or persons who complete the contact form. The contact form is designed in such a way that minimal information is required from the submitter (name, surname and email address). Other input data sent via the contact forms on this website are stored along with meta-information about the submissions, including the timestamp, originating IP address and user agent (browser). This data is used solely by the Owner(s) and for networking or informational purposes only.

This data will be kept for 10 years, unless it concerns data that the Owner(s) has obtained for a purpose for which they need it for a longer period.

The User has the right to object to this processing at any time by reporting this via info.vlaanderen@embuild.be. If you object, your Personal Data will be deleted.

Tool Circular Built

Creating an account for the Circular Built tool is structured in such a way that minimal information is required from the User (email address). During this registration, meta-information is stored, including the timestamp, the originating IP address and the user agent (browser). This data is used solely by the Owner(s) and for networking or informational purposes only.

The Circular Built tool contains 134 questions asking for properties of the building (design) that are relevant to determine the circularity ambitions of the project team for a specific construction project. The majority of the questions are yes/no questions and the User is also given the option to add notes. No questions are mandatory to complete.

The type of information requested in the 134 questions are choices that the project team wishes to make or has made in connection with the circularity of the construction project. For example:

  • Opt for wood from sustainable forest management such as FSC, PEFC.
  • The pipes of the technical installations are easily accessible for maintenance/repair/adjustments/expansions.

Method and location of data processing

Data processing method

The Owner takes appropriate security measures to prevent unauthorized access, disclosure, modification or destruction of the Data without authorization.
The processing of the Data takes place using computers and/or IT tools, following organizational procedures and methods that are closely aligned with the stated purposes. In addition to the Owner, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of this Website (administration, sales, marketing, legal, system administration) or external parties (such as external technical service providers, mail programs, hosting providers, IT companies, communications agencies). The updated list of these parties can be requested from the Owner at any time.

Legal basis for processing

The Owner may process Personal Data relating to Users in any of the following cases, if:

  • Users have given their consent for one or more specific purposes (while creating an account for the Circular Built tool or while completing the Contact Form);
    • Note: In some jurisdictions, the Owner may be allowed to process Personal Data until the User objects ("opt-out"), without the need for consent or the following legal grounds apply. However, this does not apply when European data protection law applies to the processing of Personal Data;
  • the provision of Personal Data is necessary for the execution of an agreement with the User and/or for any pre-contractual obligations thereof;
  • the processing is necessary for compliance with a legal obligation to which the Owner is subject;
  • the processing is related to a task carried out in the public interest or in the exercise of official authority vested in the Owner;
  • the processing is necessary for the purposes of the legitimate interests pursued by the Owner or by a third party.

In any case, the Owner will be happy to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Data is a statutory or contractual obligation, or a requirement necessary to enter into a contract.

Location

The Data is processed at the Owner's registered offices and other places where the parties involved in the processing are located.

Depending on the location of Users, transfers of personal data may involve transferring Users' Data to a country other than their own. For more information about the processing location of such transferred Data, Users may refer to the article detailing the processing of Personal Data.

Users are also entitled to information about the legal basis of Data transfers to a country outside the European Union, or to an international organization governed by public international law or set up by two or more countries, such as the UN, and about the security measures adopted by the Owner. are taken to protect their Data.

Storage period

Personal Data is processed and stored for as long as necessary for the purpose for which it was collected.

Therefore the following applies:

  • Personal Data collected for purposes related to the execution of an agreement between the Owner and the User will be retained until such agreement has been fully executed.
  • Personal Data collected for the purposes of the Owner's legitimate interests will be retained for as long as necessary to fulfill those purposes. Users can find specific information about the legitimate interests pursued by the Owner in the relevant articles of this document or by contacting the Owner.

The Owner may be allowed to retain Personal Data for a longer period where the User has consented to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data for a longer period where necessary for the performance of a legal obligation or on behalf of a government agency.

After the retention period, the Personal Data will be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be imposed after the expiration of the retention period.

Data use

Google Analytics (visiting the website)

This website uses Google Analytics. This program provides important statistics about the number of visitors, pages visited, traffic sources and other vital information that allows the Owners to continuously improve this website for Users. These statistics are anonymous and cannot be traced back to a specific person or user. No use is made of 'behavioral targeting', which shows you special content based on your clicking behavior; your surfing behavior remains completely anonymous. Data from contact forms is never processed or stored in Analytics.

Contact form

The information collected via the contact form (your name, your surname, your email address and possibly other information such as telephone number and organization) will, after approval, be stored in a contact list of Embuild Vlaanderen and Buildwise with the aim of informing the User about relevant news and events regarding circular construction. If the User no longer wishes to receive information about circular economy in construction, the User can request to withdraw consent after which the Personal Data will be removed from the list.

The Users are responsible for any third party Personal Data obtained and shared through this contact form and confirm that they have the third party's consent to provide the Data to the Owner.

The project data is only used to make anonymized analyzes across different projects. The project data entered in the Circular Built tool is considered strictly confidential. The Owner(s) have a duty of confidentiality with regard to the collected data. This means that they do not release any data that could identify the User or the project.

The Users are responsible for any third party Personal Data obtained and shared through the tool and confirm that they have the third party's consent to provide the Data to the Owner.

Goal of data collection and processing

The Personal Data relating to the User is collected to allow the Owner(s) to contact the Users (email address) and perform anonymized analyzes across different construction projects (project data).

The e-mail address is only used to create a personal account and to give the User access to the Circular Built tool. In case of important changes to the tool, the User will be kept informed via this entered email address. If the User agrees, the email address will also be used to contact the User about news, publications and events regarding circular construction.

The Project Data is only used to make anonymized analyzes across different projects. These analyzes can be incorporated into articles or publications, albeit still anonymously. If the Owner(s) wish to create a publication in which projects or Users are identifiable, they will contact the User for approval. Without the consent of the User concerned, the Owner(s) have no right to publish such analyses.

In addition, the data collection also allows the Owner(s) to comply with legal obligations, respond to enforcement requests, protect their rights and interests (or those of its Users or third parties), detect malicious or fraudulent activity, and for the following purposes: Tag management, Spam protection, Analytics and Manage contacts and send messages.

User Rights

Users may exercise certain rights regarding their Data processed by the Owner(s). In particular, Users have the right to do the following:

  • Withdraw their consent at any time. Users have the right to withdraw their consent if they have previously given their consent to the processing of their Personal Data.
  • To object to the processing of their Data. Users have the right to object to the processing of their data if the processing is carried out on a legal basis other than consent.
  • Gain access to their Data. Users have the right to request an overview of the persons who receive your data. Users have the right to learn if the Owner is processing Data, learn about certain aspects of the processing and obtain a copy of the Data undergoing processing.
  • To check and request rectification. Users have the right to check the accuracy of their Data and request its updating or rectification.
  • Restrict the processing of their Data. Users have the right to restrict the processing of their Data if the User contests the accuracy of the Personal Data held by the Owner(s) or if the processing is unlawful and the User opposes the deletion of the Personal Data. In such case, the Owner will not process their Data for any purpose other than storing it.
  • Have their Personal Data deleted or otherwise removed. Users have the right to have the Owner erase their Data if
    • the processing of those data is no longer necessary for the purpose for which they were collected;
    • a given consent was withdrawn;
    • an objection is given to further processing;
    • the personal data are processed unlawfully;
    • this is necessary to comply with a legal obligation; or
    • the personal data would have been collected from a child (under 13 years old).
  • Receive their Data and have it transferred to another Controller. Users have the right to receive their Data in a structured, commonly used and machine-readable format and, if technically feasible, to transmit that Data to another controller without hindrance. This provision applies provided that the Data is processed by automated means and that the processing is based on the User's consent, on an agreement to which the User is a party or on pre-contractual obligations arising therefrom.

More information about the right to object to processing

Where Personal Data is processed for the public interest, in the exercise of official authority vested in the Owner or for the purposes of the legitimate interests pursued by the Owner, the User may object to such processing by providing a supporting document to justify the objection, to give a reason related to his or her specific situation.

The Owner(s) are committed to protecting the data we process from loss, misuse or falsification. Should a breach of your data occur, and this breach entails a high risk for your rights and freedoms, the Owner(s) will notify you of this breach as soon as possible and certainly within 72 hours , under the conditions set out in the GDPR.
